1. Identity of the entrepreneur

2. Applicability

  • These general terms and conditions apply to all offers, agreements and delivery of Boufarrah.
     

  • If the contract is concluded at a distance, the text of these general conditions may be made available to the consumer electronically in such a way that it can be easily stored by the consumer on a durable data carrier. If this is not reasonably possible, before the distance contract is concluded, it will be indicated where the general terms and conditions can be inspected electronically and that, at the consumer's request, they will be sent electronically or otherwise free of charge.

  • In the event that specific product or service conditions apply in addition to these general conditions, these conditions apply accordingly and in the event of conflicting conditions the consumer can always rely on the applicable provision that is most favorable to him.

3. The offer

  • Offers are valid while supplies last.
     

  • The offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to allow a proper assessment of the offer by the consumer. When Boufarrah uses images, these are a true representation of the products offered. 
     

  • The products of Boufarrah are imported from Morocco and are handmade. This means that the product is natural and pure and there is a shelf life of a maximum of 12 months. Each offer contains such information that it is clear to the consumer what rights and obligations are attached to the acceptance of the offer.

4. The agreement

  • The agreement is concluded at the moment of acceptance by the consumer of the offer and the fulfillment of the conditions set forth thereby by Boufarrah.

  • If the consumer has accepted the offer electronically, Boufarrah shall immediately confirm the receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed by Boufarrah, the consumer may dissolve the contract.
     

  • Boufarrah may - within legal frameworks - inform itself whether the consumer can fulfill its payment obligations, as well as all those facts and factors that are important for a responsible conclusion of the distance contract. If, based on this investigation, Boufarrah has good grounds not to enter into the agreement, it is entitled to refuse an order or application, or to attach special conditions to the execution, such as the payment of a deposit.

5.  Right of withdrawal

  • The consumer can dissolve a contract relating to the purchase of a product during a 14-day period without giving reasons. The entrepreneur may ask the consumer about the reason for withdrawal, but may not oblige the consumer to give his reason(s).

​

  • The direct costs for the return shipment shall be borne by customer. Customer must therefore bear the return costs himself. The costs for the return are € 6.75 in the Netherlands. 

​

  • Items can only be returned unopened and in their original condition. Returns that do not meet our policy* will not be accepted and will be sent back to customer. 

    *Due to the strict EcoCert, ONSSA, USDA and FDA safety standards we meet, we are unable to return items in non-sleable conditions such as: 

  • Unsealed

  • Swatched/Used 

  • Relabelled

  • Refiled

  • Partially missing items

  • If the consumer exercises his right of withdrawal, he notifies within the withdrawal period by emailing info@boufarrah.nl.

6. Ownership of intellectual property, copyrights and logos

7. Price

  • During the validity period stated in the offer, the prices of the products offered will not be increased, except for price changes resulting from changes in VAT rates.

 

  • Notwithstanding the previous paragraph, Boufarrah may offer products or services whose prices are tied to fluctuations in the financial market and over which Boufarrah has no influence, with variable prices. This link to fluctuations and the fact that any prices quoted are target prices shall be stated with the offer.
     

  • The prices mentioned in the offer of products include VAT.

8. Delivery and execution

  • Boufarrah will take the greatest possible care when receiving and executing orders for products.

 

  • The place of delivery is the address that the consumer has made known to the entrepreneur.
     

  • Subject to what is stated in article 4 of these general terms and conditions, the entrepreneur will execute accepted orders expeditiously but at the latest within 30 days, unless another delivery period has been agreed. If delivery is delayed, or if an order cannot or can only be partially carried out, the consumer will be informed about this within 30 days after the order was placed. The consumer in that case has the right to dissolve the agreement without cost and right to possible compensation.
     

  • After dissolution in accordance with the previous paragraph, the entrepreneur will refund the amount paid by the consumer without delay.
     

  • The risk of damage and/or loss of products rests with Boufarrah until the moment of delivery to the consumer or a representative designated in advance and made known to Boufarrah unless expressly agreed otherwise.

9. Payment

  • Unless otherwise provided in the agreement or additional conditions, the amounts owed by the consumer must be paid within 14 days of the start of the cooling-off period, or in the absence of a cooling-off period within 14 days of the conclusion of the agreement.
     

  • If the consumer does not timely fulfill his/her payment obligation(s), after Boufarrah has informed the consumer of the late payment, and Boufarrah has granted the consumer a period of 14 days to still fulfill his/her payment obligations, after the failure to pay within this 14-day period, the consumer owes the statutory interest on the outstanding amount and Boufarrah may charge the extrajudicial collection costs incurred by Boufarrah. These collection costs shall amount to a maximum of: 15% on outstanding amounts up to € 2,500; 10% on the following € 2,500 and 5% on the following € 5,000, with a minimum of € 40. Boufarrah may deviate from said amounts and percentages for the benefit of the consumer.

10. Complaints procedure

  • If the consumer has a complaint about a product (in accordance with Article regarding warranty and conformity) and/or about other aspects of the service provided by Boufarrah; he can submit a complaint to Boufarrah by e-mail or by post. See the contact information at the top of the General Conditions.
     

  • Boufarrah will respond to the consumer's complaint as soon as possible, but in any case within 14 days of receipt of the complaint. If it is not yet possible to provide a substantive or definitive response, Boufarrah will confirm within 14 days of the receipt of the complaint and give an indication of the period within which it expects to provide a substantive or definitive response to the customer's complaint.

11. Disputes

On agreements between the entrepreneur and the consumer to which these general conditions relate, only Dutch law applies.
